2026 Complexity Level Determination - Air Operating Permit

Comment on the complexity level determination for air operating permits. We use this determination to help set fees for air operating permits. Fees are based on three parts (or tiers): complexity level, emissions, and a flat fee.


The 2026 annual fee reflects permit-related costs between July 1, 2025 – June 30, 2026.


Next steps

After the public comment period ends, we will:

  • Review and respond to comments.
  • Finalize the complexity level.
  • Send a bill in January 2026 to each air operating permit holder.
  • Update those who provide contact information.
